Labor is seeking to legislate to ban citizens of countries like Iran and Iraq from coming into the country unless their governments accept immigration detainees Australian authorities want to deport.
Draft legislation drawn up by the government, that went through the Labor caucus on Tuesday in reaction to an upcoming High Court challenge from an Iranian detainee ASF17, seeks to jail detainees who fail to agree to their forced removal for a mandatory minimum period of one year with a maximum penalty of five years.
But the legislation also gives governments the power to nominate countries to which it will not grant visas called “removal concern countries”.
Sky News Australia has been told possible countries for this ban include Iran and Iraq.
The explanatory memorandum for the draft legislation states the bill seeks: “Designating a country as a removal concern country, and imposing a bar on new visa applications from no-citizens outside Australia who are nationals of a country that does not accept removals reflects the government’s expectation that a foreign country will cooperate with Australia to facilitate the lawful removal of a non-citizen who is a national of that country.
“... The designation would also ensure the removal concern country is aware of Australia’s concerns in relation to the removal of the country’s nationals from Australia where they have no valid reason to remain, and Australia’s expectations of cooperation by that country in relation to the prompt and lawful removal of its nationals.”
The minister would be able to make some exemptions.
The explanatory memorandum adds the measure is necessary to “slow down that entry pipeline into Australia and reduce growth in the cohort of potentially intractable removals over time”.
