Australian neurosurgeon Charlie Teo has been found guilty of unsatisfactory professional conduct by the Health Care Complaints Commission, which has placed conditions on his registration.

An eight-day disciplinary hearing against him was held earlier this year.

Dr Teo was fighting two complaints of unprofessional conduct from the families of two different women, who say they were not properly warned about the risk of death before consenting to surgery.

Both women failed to wake up from surgeries in 2018 and 2019, and later died.

In its 112-page decision released on Wednesday morning, the commission found four elements of the complaints were "proven".

They included deciding to operate on two patients where the risk of surgery outweighed any potential benefits of the surgery, not obtaining informed consent from both patients before surgery, and speaking inappropriately to a patient's daughter after surgery.

The committee ordered Dr Teo to be reprimanded and imposed conditions on his registration to protect the public, including having written permission from another neurosurgeon before performing specific surgical procedures.

The committee’s report describes both patients as “vulnerable women facing the prospect of death from their respective brain tumours”. 

It concludes that Dr Teo did not exercise appropriate judgement in relation to the 2018 surgery, and carried out surgery different to what was proposed to the patient in 2019.

The neurosurgeon must receive written approval to operate on patients.()

The committee said Dr Teo’s “lack of reflection” on his judgement in offering surgery without supporting data or peer support was of great significance.

It acknowledged Dr Teo expressed sorrow and took responsibility for the bad outcomes, but he did not express remorse for offering surgery to the patients.

“This lack of insight into his judgement causes us concern,” the report said.

During the inquiry, there were 47 letters of support from former patients and their families and more than 100 pages of social media messages in support of the surgeon. 

Dr Teo told the committee he believed he was "hated" by other doctors and the complaints against him were coerced by "enemies" in the medical fraternity. 

He was previously banned from practicing in Australia without written permission from another neurosurgeon and may have those restrictions extended.
