A man released from immigration detention as a result of the High Court's ruling on indefinite detention has faced an Adelaide court charged with two counts of indecent assault.
Key points:
- Aliyawar Yawari, 65, was arrested at a motel in Adelaide on Saturday
- He is one of 148 people released in response to last month's High Court ruling on indefinite immigration detention
- Australian Border Force says two people released as a result of the High Court decision have now been charged
Aliyawar Yawari appeared in the Adelaide Magistrates Court on Monday, three weeks after he was released from Yongah Hill Immigration Detention Centre in Western Australia.
The 65-year-old was arrested at a motel in the Adelaide suburb of Pooraka on Saturday night after a report a woman had been indecently assaulted by a guest.
He did not apply for bail and has been remanded in custody until next month.
Mr Yawari was one of 148 people released in response to last month's High Court ruling that indefinite immigration detention is unlawful where there is no prospect of them being deported in the reasonably foreseeable future.
He has previously been accused of attacking three women and was convicted of assault in 2016.
The Australian Border Force has confirmed two people released as a result of the High Court's decision have recently been charged — one in New South Wales and one in South Australia.
The former detainee charged in New South Wales has been released on bail.
Speaking in the Senate, Foreign Minister Penny Wong confirmed the arrests.
"I understand that two detainees — one in NSW and another in SA — have recently been charged and one individual remains in police custody," Senator Wong said.
Federal cabinet on Monday considered a proposal to expand the preventative detention regime in response to the ruling, the latest in a series of legislative changes.
The government wants to extend the existing anti-terror laws, introduced by the former Coalition government, to apply to serious violent and sexual offenders if they pose a risk to the community.
